I THINK IT'S IMPORTANT THAT AS THE SENATOR REPRESENTING THE CITY OF PETERSBURG THAT YOU'RE AWARE OF THOSE BILLS THAT I INTEND TO INTRODUCE. FIRST OF ALL, AS MANY OF YOU KNOW, I SORT OF BOTH ON JUDICIARY, AGRICULTURE, REHABILITATION, SOCIAL SERVICES AND LOCAL GOVERNMENT. UM, THE. AND HE ALSO HAS THE ABILITY TO CONDUCT IMPROMPTU INSPECTIONS AS HE DEEMS APPROPRIATE FOR THE HOTEL IN ADDITION TO THE ANNUAL INSPECTIONS. AS HE MADE THE NECESSARY. TO FOLLOW UP ON PRE OPERATIONAL INSPECTION OF ONE OR MORE VIOLATIONS. AS REQUIRED BY UNIFORMLY APPLIED RISK BASED SCHEDULE ESTABLISHED BY THE DEPARTMENT OR AS NECESSARY TO INVESTIGATE A COMPLAINT REGARDING A HOTEL OR IS OTHERWISE DEEMED NECESSARY BY THE COMMISSIONER. UM, USUALLY OWNERS OF ESTABLISHMENTS SUCH AS THESE HOTELS ARE WELCOME THAT TYPE OF ACTIVITY. IT ALSO BENEFITS THE OFFICERS AND ENABLING THEM TO HAVE SOMEWHERE TO GO AND WORK ON THEIR REPORTS AND VARIOUS ISSUES OUTSIDE OF THE VEHICLE, ANOTHER DANGERS THAT THERE MIGHT BE DOING IT OUT OUTSIDE OUT IN THE OPEN. AND THEN THE OTHER THING THAT POLICE DEPARTMENTS CAN DO ON A REGULAR BASIS TO TRY TO ADDRESS CRIMINAL AND DRUG ACTIVITY ON HOTELS AND MOTELS, IS SOMETHING KNOWN AS BUCKET CHECKS. UM, YOU'RE PROBABLY WONDERING WHAT IS. BUCKET CHECK WELL UNDER THE STATE CODE AND. UNDER THE PETERSBURG CITY CODE, HOTELS AND MOTELS ARE REQUIRED TO MAINTAIN WRITTEN GUEST REGISTERS. IF YOU NOTICE WHATEVER YOU GO INTO A HOTEL YOU'RE REQUIRED TO GIVE YOUR DRIVER'S LICENSE OR SOME FORM OF VALID IDENTIFICATION IN ORDER TO GET THE ROOM. THAT'S BECAUSE MOST STATES, INCLUDING VIRGINIA , REQUIRE GUESTS TO PROVIDE VALID PHOTO ID. THEY ALSO REQUIRE THAT THE HOTEL'S RECORD THIS INFORMATION IN A REGISTER AND THE OTHER THING THAT THEY DO IS THAT THEY ALLOW OPEN ACCESS TO THIS INFORMATION BY LAW ENFORCEMENT SO A LAW ENFORCEMENT OFFICER CONDUCTING A BUCKET CHECK IS SIMPLY GOING INTO A HOTEL OR MOTEL AND ASKING TO SEE THE GUEST TO REGISTER AND THE REASON THAT OFFICERS DO THAT.

ARE. FOR OUR FOR A NUMBER OF REASONS. ALLEGED TO RUN AWAY. OTHER THINGS THAT ARE FOUND DURING THESE BUCKET CHECKS ARE THAT PEOPLE HAVE GIVEN FALSE INFORMATION OR INFORMATION THAT DOESN'T MATCH ANY RECORD THAT YOU'RE ABLE TO FIND. UM AND THEU DETERMINE THROUGH THESE, UH, BUCKET CHECKS ARE YOU YOU CAN CREATE, UM SOME PROBABLE CAUSE TO ESTABLISH THAT THAT SOMEONE IS ENGAGING IN UNLAWFUL OR CRIMINAL ACTIVITY. UM FOR EXAMPLE, SOMEONE WHO LIVES TWO BLOCKS DOWN THE STREET AND WHO GETS A HOTEL, UM, ON A REGULAR BASIS. THERE MAY BE NOTHING TO IT. BUT YOU KNOW, THERE MAY ALSO BE SOMETHING TO IT AS WELL AND THE CIRCUMSTANTIAL EVIDENCE ESTABLISHING THE TIMELINE OF

THEM THE FREQUENCY OF THEM GETTING HOTEL AT THAT LOCATION WHEN THEY HAVE A DOMICILE DOWN THE STREET CAN SUPPORT A CASE IF YOU CAN GET ADDITIONAL EVIDENCE THAT WOULD SUPPORT PROBLEM CAUSE FOR AN INVESTIGATION AND PERHAPS AN ARREST. AND SO THOSE. THE THINGS THAT THE POLICE DEPARTMENT CAN DO, UM, TO HELP ADDRESS ISSUES ON HOTELS AND MOTELS. UM. ONE OF THE THINGS THAT THE COMMISSIONER REVENUES OFFICE CAN DO, AND THEY DO IT IN THIS CITY IS THAT THEY COLLECT A TRANSIENT LODGING, TAX OR TRANSIENT OCCUPANCY TAX, AND THAT IS A ATTACKS THAT MUST BE PAID BY PEOPLE WHO ARE STAYING WITHIN THE CITY OF PETERSBURG WHO ARE NOT PERMANENT RESIDENTS.

AND THE REASON THAT THAT HAS DONE IS TO DETER SOME OF THE ACTIVITIES THAT COUNCILWOMAN WILSON SMITH IS TALKING ABOUT, AND THAT IS WHEN PEOPLE GET AROUND THE TEMPORARY NATURE OF HOTELS BY STAYING UP TO 30 DAYS AND THEN UM, HAVING THE HOTEL IN OR MOVE THEM TO ANOTHER HOST.

ANOTHER ROOM. OR JUST MOVING TO ANOTHER HOTEL WITHIN THE CITY THAT CAN BECOME VERY EXPENSIVE AND THE REASON IT BECOMES VERY EXPENSIVE IS THROUGH AGGRESSIVE COLLECTION OF THIS TRANSIENT OCCUPANCY TAX, AND I KNOW THAT OUR COMMISSIONER IS AWARE OF THIS AND IS ACTIVELY WORKING TO ENGAGE IN COLLECTIONS OF THIS TAX. BUT THAT IS ONE OF THE DETERRENCE TO PEOPLE USING THESE HOTELS FOR THINGS THAT THEY ARE NOT INTENDED TO BE USED FOR. ANOTHER ENFORCEMENT ARM THAT CAN AID IN THE EFFORT TO ADDRESS ISSUES ON HOTELS AND MOTELS IS THE ZONING ADMINISTRATOR. UM ONE OF THE THINGS THAT IS IMPORTANT FOR THE ZONING ADMINISTRATOR DO IS TO ENSURE COMPLIANCE WITH THE EXISTING PROVISIONS OF THE ZONING ORDINANCE. THEY REQUIRED TO HAVE A CERTAIN AMOUNT OF OFF STREET PARKING, FOR EXAMPLE, THEY'RE REQUIRED TO HAVE A CERTAIN TIME PERIOD WITH REGARD TO THEIR OCCUPANCY, AND THAT NEEDS TO BE MONITORED ON A REGULAR BASIS. THEY HAVE A CERTIFICATE OF OCCUPANCY, ALLOWING THEM TO HAVE A CERTAIN NUMBER OF PEOPLE AND OPERATE A CERTAIN TYPE OF BUSINESS. AND IF THEY'RE OUT OF COMPLIANCE WITH THAT, AND THAT IS SOMETHING THAT THE ZONING ADMINISTRATOR CAN ADDRESS. THE OTHER THING THAT'S IMPORTANT IS DETERRING FURTHER ACTIVITY OR HOTELS AND MOTELS THAT AREN'T AND PROBLEM BECOMING A PROBLEM. SO WHERE HOTELS AND MOTELS ARE REQUIRED TO HAVE A CONDITIONAL USE, PERMIT OR HERE WE CALL THE SPECIAL USE PERMITS . IT'S IMPORTANT FOR THE ZONING ADMINISTRATOR TO ENSURE THAT THE CONDITIONS ARE CLEAR AND THAT THEIR ADHERED TO BY THE OPERATOR AND WHAT I MEAN BY THAT, AND I AND THEN FINALLY THEY PROPERLY ADMINISTER THE PROVISION OF TWO DEATHS. 62 B THREE OF THE PETERSBURG CITY CODE, WHICH I'M GOING TO TALK ABOUT. WHEN I WAS THERE WHEN SOMEONE WAS APPLYING FOR EXTENDED, STAY CONDITIONAL USE PERMIT, AND I THINK THE MOST IMPORTANT OF THESE CONDITIONS ARE IS SOMETHING THAT I SELDOM IF EVER HAVE SEEN HERE IN PETERSBURG. AND THERE'S NUMBER FOUR. WE USED TO REQUIRE THAT ONLY A CERTAIN NUMBER OF CRIMINAL CALLS FOR SERVICE WERE PERMISSIBLE AT A PROPERTY IN THIS CASE, NO MORE THAN THREE CRIMINAL POLICE CALLS AS DETERMINED BY THE POLICE CHIEF CAN BE ATTRIBUTABLE TO THE FACILITY WITHIN A 30 DAY, CONTINUOUS PERIOD. AFTER WHICH THE FACILITY MANAGEMENT PLAN SHALL BE SUBMITTED AND APPROVED BY THE CHIEF OF POLICE IN ORDER TO PRESERVE THEIR CONDITIONAL USE, PERMIT OR SPECIAL USE PERMIT AS WE CALL IT HERE. UM MY RECOLLECTION IS THAT THE ARTICLE THAT WE WERE TALKING ABOUT REGARDING OYO SAID THAT THEY HAD HAD 196 CALLS FOR SERVICE AND SO THEY WOULD HAVE BY FAR VIOLATED THIS CONDITION AND WOULD NOT HAVE BEEN ABLE TO CONTINUE TO OPERATE WHERE THEY OPERATING IN WINCHESTER UNDER A CONDITIONAL OR SPECIAL USE PERMIT. ANOTHER THING THAT WE DON'T SEE OFTEN THAT WE SHOULD START TRYING TO INCORPORATE IN THE ISSUANCE OF SPECIAL OR CONDITIONAL USE PERMIT IS A REVIEW OF COMPLIANCE PERIOD. AS YOU CAN SEE, NUMBER FIVE AND NUMBER SIX. YOU'VE GOT A SIX MONTH REVIEW OF COMPLIANCE WITH THE PERMIT SHALL BE CONDUCTED BY STAFF. ANY SUBSTANTIAL ISSUES OF NON COMPLIANCE SHALL CAUSE THE CPI TO BE BROUGHT BACK TO CITY COUNCIL FOR MODIFICATION OR REVOCATION OF THE PERMIT. AND STAFF REVIEWING APPROVAL. THE SITE PLANS REQUIRED. UM THOSE CONDITIONS CAN BE INVALUABLE BECAUSE 6 10 YEARS FROM NOW, WHEN OTHER MEMBERS OF COUNCIL MAYBE SITTING AT THE DIOCESE. THEY'RE NOT GOING TO KNOW THAT I CAN AND CONDITIONAL USE PERMIT WAS ISSUED FOR THIS PARTICULAR PROPERTY AND THESE CONDITIONS

WERE IMPOSED AND SO BY PUTTING A REVIEW OF COMPLIANCE REQUIREMENT IN YOUR CONDITIONAL USE OR SPECIAL USE PERMIT. YOU ENABLE YOURSELF TO ENSURE THAT THEY'RE COMPLYING WITH THE CONDITIONS THAT HAVE BEEN IMPOSED. WITH REGARD TO SECTION TWO DAY 62. WHAT I'M TALKING ABOUT IS SECTION B THREE. WELL, THAT IS SPECIFICALLY, UM COUNCILMAN WILSON SMITH HAD MENTIONED THAT THEY'RE NOT ALLOWED UNDER THE STATEWIDE FIRE PREVENTION CODE TO STAY MORE THAN 30 DAYS AND A 60 DAY PERIOD. HOWEVER THERE'S AN EXCEPTION TO THAT IN SECTION 2-62 OF THE CITY CODE, WHICH SAYS WHERE THE ZONING ADMINISTRATOR AUTHORIZES IN WRITING AFTER CONSULTATION WITH HUMAN SERVICES DIRECTOR STAY FOR AN ADDITIONAL PERIOD OF UP TO 90 DAYS TO PREVENT RESIDENTS FROM BECOMING HOMELESS. IN THE EVENT THAT THE DEPARTMENT OF SUCH SERVICES UNABLE TO IDENTIFY APPROPRIATE ALTERNATIVE HOUSING WITHIN 90 DAYS, THIS 90 DAY PERIOD CAN BE EXTENDED IN WRITING BY THE ZONING ADMINISTRATOR. SO THAT'S AN AUTHORITY THAT THE ZONING ADMINISTRATOR HAS TO EVEN EXTEND BEYOND WHAT THE LIMITATIONS OF THE STATE CODE FIRE PREVENTION CODE IN THE CITY CODE ALLOW BUT THAT NEEDS TO BE USED IN MONITORED CAREFULLY TO ENSURE THAT IT'S NOT ABUSED AND THAT'S SOMETHING ZONING ADMINISTRATOR WOULD NEED TO DO. BUILDING CODE ENFORCEMENT IS ANOTHER ENFORCEMENT AGENCY THAT IS ABLE TO HELP ADDRESS THESE HOTEL AND MOTEL ISSUES TO A LARGE EXTENT, OBVIOUSLY STRICTLY ENFORCING VIOLATIONS OF THE UNIFORM STATEWIDE BUILDING CODE FOR PROPERTY MAINTENANCE ISSUES. BUT ALSO ENFORCING THE OCCUPANCY REQUIREMENTS AS OF CODE TO DASH 62 INVESTIGATING ALLEGED VIOLATIONS. AS FAR AS THE 30 DAY REQUIREMENT. YOU KNOW, SHE'S EXACTLY RIGHT. YOU CAN STAY FOR UP TO 30 DAYS. PURSUANT TO THE STATE CODE, BUT AGAIN AFTER THAT 30 DAYS HAS EXPIRED. THEY'RE SUPPOSED TO MOVE ON. THERE ARE EFFORTS TO THWART THAT ON OCCASION, BUT IT'S OFTEN BY PEOPLE WHO ARE HOMELESS. SO YOU'RE KIND OF BETWEEN A ROCK AND A HARD PLACE IN TRYING TO DEAL WITH PERSONS WHO ARE UNABLE TO LOCATE TO A PERMANENT DOMICILE AND HAVE TO LIVE IN THESE HOTELS, SO THE EFFORT NEEDS TO BE TO ADDRESS THE DEEPER ISSUES AND THAT IS THE DRUG AND CRIMINAL ACTIVITY THAT'S OCCURRING ON THE. SO THEY'RE THE ADDITIONAL MEANS OF ADDRESSING, UM SIGNIFICANT PROBLEMS THAT YOU HAVE WITH HOTELS AND MOTELS. I THINK WE'RE DOING IT CURRENTLY WITH THE RAMADA, AND THAT IS DECLARING THE PROPERTY TO BE A PUBLIC NUISANCE. YOU KNOW, AS YOU CAN SEE. UM IT'S NOT A QUICK AND EASY FIX. I MEAN, IT'S PRIVATELY OWNED PROPERTY, AND SO THE EFFORT HAS TO BE TO ESTABLISH A SERIES OF ONGOING VIOLATIONS, WHICH NEGATIVELY NEGATIVELY IMPACT HEALTH, SAFETY AND WELFARE. THIS IS DRIVEN BY THE ENFORCEMENT AGENCIES SO THE ENFORCEMENT AGENCY NEEDS TO REALLY GO ADAM AND REALLY PURSUE THE VIOLATIONS AND ORDER US IN ORDER FOR US TO ESTABLISH THE EXISTENCE OF A PUBLIC NUISANCE. ANOTHER THING THAT CAN OCCUR AS AS CITIZENS CAN ACTUALLY INITIATED PRIVATE ACTION UNDER SECTION 48-1 OF THE CODE OF VIRGINIA AND THAT ACTUALLY PROVIDES THAT WHEN A COMPLAINT IS MADE TO THE CIRCUIT COURT OF ANY COUNTY OR THE CORPORATION COURT OF ANY CITY OF ITS COMMONWEALTH BY FIVE OR MORE CITIZENS OF ANY COUNTY CITY OR TOWN, SETTING FORTH THE EXISTENCE OF A PUBLIC OR COMMON NUISANCE. THE COURT OR THE JUDGE THEREOF IN VACATION SHALL SUMMON A SPECIAL GRAND JURY IN THE MODE PROVIDED BY LAW TO THE NEXT JOURNAL. LET'S JUST ADOPT ANOTHER ORDINANCE, AND I DON'T THINK THAT THAT IS THE ANSWER. THERE ARE PLENTY OF TOOLS AT THE CITY'S DISPOSAL TO TRY TO ADDRESS THESE ISSUES. BUT WHAT COUNCIL CAN DO IS FORMALLY INSTRUCT THE MANAGER TO MAKE HOTEL AND MOTEL INTERDICTION A PRIORITY FOR THE CITY. IF IT'S A REAL PROBLEM THAT NEEDS TO BE ADDRESSED, ADDRESSED, THEN THE CITY'S EFFORTS AND RESOURCES

SHOULD BE DIRECTED TOWARD THOSE ISSUES. WE SHOULD HAVE STATUS STAFF REPORT AND IDENTIFY WHICH PROPERTIES POSE THE HIGHEST RISK TO HEALTH, SAFETY AND WELFARE AND DESCRIBE IN DETAIL TO CITY COUNCIL. WHY THOSE PROPERTIES CONSTITUTES SUCH A THREAT, AND THEN WE SHOULD ENCOURAGE STAFF TO WORK WITH THE PROPERTY OWNERS INITIALLY TO TRY TO BRING THEM INTO COMPLIANCE, BECAUSE, LIKE I SAID, IT'S NOT ALWAYS NECESSARY TO HAMMER DOWN, THOUGH YOU KNOW , SOME OF THEM ARE GOING BEYOND OUR ABILITY TO BRING BACK PERHAPS, AND THEN FINALLY, UM COUNCIL SHOULD CONSIDER APPROPRIATING FUNDING AS DEEMED NECESSARY BY STAFF OR THE ELIMINATION OF THE NEGATIVE IMPACTS THAT THEY IDENTIFY. IF WE'RE GOING TO ADDRESS THE HOTELS AND MOTELS OF THESE ARE PROBLEM THAN THE WAY TO DO IT IS TO INVEST THE CITY'S TIME AND RESOURCES AND MANPOWER INTO FIXING THE PROBLEM.
